Sear leg on eMag drags on safety

The sear leg on my eMag drags on the safety when it's in the "fire" position. To me it looks like it always would. Like the safety isn't made correctly. That doesn't seem likely. Any ideas?

When you push in the safety to put it in the fire mode, does the "safe" side of the sear sit flush against the frame?
