O yay, now the mag will be known to some as cheap spyder clones

Off hand I would say System-X makes them. And I won't elaborate on quality because I am extremely prejudiced against them. I bought on of their first barrels and the chrome flaked after the first game and their customer service back then was :cuss: .

We all know the mag is niether cheap nor a Spyder clone. But the rest of the world will now think they are. Sad really................

Was't the original Automag a .44 magnum pistol made by AMT? or how about these guys

Technically, the AGD Paintball gun is the 68Automag. If I remember correctly, Tom said they added the 68 to avoid infringing on the nakesake, and I guess since it's in a different market, it's no issue.

Clint Eastwood brandishing his .44 auto mag - "When used correctly, this will remove the finger prints."

Yeah, AMT's had gear out for years, they're prety much collector's items at this point since AMT is long gone.

The name difference is pretty easy, AMT put a space between the two words, Tom didnt.

That's no typo - I garauntee you they knew exactly what they were doing when they placed that add with that description of that brown-lawn-ornament of a marker. Sorry *** Chinese crap.

well considering its not exactly the same name, i really don't think legal action is really possible.

In my non-educated opinion (Im not a lawyer) its a clear violation of trade dress laws. Use of the name, or a name so close that it could confuse consumers.

They have AutoMag, AGD has 68Automag. That capital m will probably prevent any legal action.

well look at wal-mart and k-mart, they dont sure over the use of mart. And if im not mistaken, there are other products with the name automag in it.

Anyone can sue anyone over anything. I don't like your hair color, I can take you to court because if it. I probably would not win and be laughed out of the court room, but I can do it. The name automag can be used, but I am sure Tom does like it being used in the paintball world. I don't think it falls under trade dress, but I am sure you could convince the court that they are in the wrong.

This is kind of like Apple computers and Apple (the record company). They had an agreement from back in the early 80's where Apple computer would only use the name "Apple" in the computer industry. When they moved into the music market (iTunes) the name "Apple" was going to used. Apple (the record company) put a stop to it.

D'uh. :tard:

"Mart" is an English word and can't be trademarked.
Look it up in the dictionary:
http://www.m-w.com/cgi-bin/dictionary?book=Dictionary&va=mart&x=12&y=12

Apple Computer vs. Applecorps is also a case of Trademark/Tradename

I realize that but auto and mag are also in there. I was just trying to make a point. Since the name isnt exactly the same, AGD can really do nothing about it.

Edit: Also, type in automag in google and see how many non-AGD sites pop-up.

actually about a quarter of them are non paintball related.

Did i say it was no. Auto and mag are, just as mart is not k-mart or wal-mart.

Ok, and the ones that are paintball releated are about the AGD Automag right?

What I am getting at is that if someone came out with a car called the "Automag" Tom would care less and wouldn't bother taking any kind of legal actions. And if he did I am pretty sure he would lose.

But, if a paintball company comes out with a new gun called the "Automag" Tom would be upset and probably take legal actions...and well...he would probably win.

Did i say it was no. Auto and mag are, just as mart is not k-mart or wal-mart.

Let's have a little basic lesson:

mart, mag, auto, all actual words, free to use in any combination.

Automag, Kmart, Walmart, all combinations of actual and/or invented words can be claimed as trademarks and tradenames.

Guido >> Common Name
Pizzaria >> Common Business

Guido's Pizzaria >> Trademarkable name. If first on the block/in a city stands a good chance of stoppinganyone else from using the name locally. If it gets registered federally, capable of stopping anyone in the nation from using it.

It's not that hard to understand. Or are you trying to make a point I'm missing....

Now wait, AGD should just wait until this company grows large and then when nobody is paying attention suckerpunch them with a bunch of lawsuits over patent infringement. Yeah that would be the most clever thing ever.....oh wait....

magman007
02-09-2005, 06:36 PM
why would agd wait for any company to get larger? so that he has the better chance of loosing?

SlartyBartFast - Thats what im trying to say, thank you. They use automag in a combination, they don't outright steal it.

Even if a company that has nothing to do with the same industry take your same name, they could still inflict damage upon your reputation. I.E. bad business practices, fraud, debt and so forth.

does automag even have a copyright or does just AGD have one??

No, no, no, no, no, no. :nono:

You just aren't getting it.

AUTOMAG is the trademark. YOU CAN'T USE SOMEONE ELSE'S TRADEMARK TO SELL ANOTHER PRODUCT! PARTICULARLY IN THE SAME INDUSTRY!

Cripes. You think you could operate a store called "Jack's Walmart"?
