On April 30th, 2007, Attorneys for AJ Intermediate Holdings and AJ Acquisition I (doing business as National Paintball Supply) (and now essentially KEE Action Sports) have filed for summary judgment against two of the defendant parties in the 'DXS Pulse' action.

Parties to the case are the aforementioned Plaintiffs (the companies bringing the suit) and the following entities (who�s relationship(s) to each other and to the law suit in question are not specifically described in this action*), the Defendants (the companies against whom the suit has been entered):

Cousins Paintball Mt Kisco LLC of Mt. Kisco NY,
PROCAPS Direct of VA,
Michael Spurlock of Taiwan,
Wu Chu Min ("Jimmy") of Taiwan and
Marcasite Industrial Co LTD of Taiwan

According to court documents (filed on PACER), Plaintiff's attorneys served Wu Chu Min and Marcasite (as well as those named above) with proper notice of the suit twenty days ago. These two parties have failed to respond in any way and Plaintiff's have therefore requested summary judgment against them (a default judgment against them due to the failure to respond).

*the parties served include entities other than those named in the Civil Action No. 1:07-CV-00192 JHR-AMD court filing. According to the 'certificate of service' letter (an attorney's legal statement that they have served notice in the accepted and properly documented manner) filed with the court, the following parties were served:

Procaps LP, Procaps Direct, Strategic Sports inc (d/b/a Pev's Paintball), Cousins Paintball Mt. Kisco LLC, Imperial Capital Corporation, Michael Spurlock, Wu Chu Min ("Jimmy") and Marcasite Industrial Co. LTD.

It should also be noted that merely being named in a suit does not necessarily indicate involvement, guilt or responsibility. Attorneys often engage in the practice of 'casting a wide net' when bringing a suit, naming as many parties as can reasonably be included.

It should also be noted that Federal District Court Judges do not appreciate being ignored.
