View Full Version : Questions to AGD, why not counter SP's lawsuit with one of your own?

Here is my question, why doesn't AGD counter with a bigger law suit... I mean

who made the first carbon fibre tanks - AGD
the first magnetic triggers - AGD
the tube shaped design which SP is currently using - AGD

Im just wondering cause AGD could patent these things since it was originally AGD designs. You could only crack down on SP and leave the other companys to do as they wish. That way SP knows that the paintball industry is mad about thier recent patent no the on/off switches. could this be done?

Um. No.

Doesn't work that way, and wouldn't happen even if it did.

First off you can't patent something once its been out in public for more than a year. Second when we came up with all those ideas it made more sense to let everyone use them that way the sport would grow and we would all make more money.

good point, that doesnt make very much sense, this SP business is getting out of hand... one thing that annoys me is that they arent after anything special, they just want more money...plus it wasnt really their ideas in the first place...

Yes, but they didnt just get a new patent, they REVISED their patent. They must have gotten it before a year had passed but it was just recently revised to allow them to do this.

Does AGD have any sort of minor patent on the air tanks then? Or the tube design? Something to be "revised" :)

Tom I think its great that your having the sport grown and all, but you do patent the things you do for a day like this dont you? or even if its not for a situation like this.

[question on patents]
does that rule about the product being in public for less than a year only apply to the product of the manufacturer(m3's stacked tube design for example versus the stacked tube general design)

would that be why whomever did it, could patent powerfeed years after it was really invented and introduced to the public?
