Amazeing....this is terrible news to me as I am a ICD fan. Now that they are making an agreement can they still take this to court again? If I understand this correctly, then shouldn't other companies at risk from Smartparts help out ICD as this case can be used in the future againist other companies? Heh enlighten me, for I don't like law much even though my mom is an assistant attorney general and my dad is a judge

Dye owns the rights to make their version of the matrix (aka the Dye Cockers) but they do nOT own the company
oh, and SP prolly could knock down AGD if that was their desire...although maybe it would be a blessing in disguise for AGD (would put an end to endless waiting lines for X-Mags)
with Dye, NPS, and ICD giving into the SP claim, that leaves namely kingman and BE left to put up a serious stop to SP.
and BE has recieved notices from SP to cease making electro markers, but BE thus far has stood strong and will continue to make markers until a court tells them they can'tComment

well...my basis is this:
It would be a sad day to see my favorite company lose. i mean i'm used to beating SP products in the field, and AGD beats them in quality...it would be out of character for AGD to lose in court.
i think maybe my statement is simply my way of saying i stand behing AGD, and it would suck if it happened.

I had to read that a couple times this afternoon, and I still don't get it. They don't make it clear whether they LOST in court or they just GAVE UP and signed an agreement.
Settlement Agreement - That leads you to assume they lost in court.
Now this makes it sound like there was a preliminary hearing where ICD lost (a warmup court appearance).
This agreement means that ICD can no longer defend against SP. All arguments are denied. It almost sounds like it may be a court precident right there. Hope not!Comment
