    Which only mitigates the charge.

Intent determines whether the the charge is assault or agravated assault and the appropriate sanction.

"Not meaning to" NEVER absolves you of responsibility.

The following are American definitions, but probably don't differ much from BC equivalents.

"AGGRAVATED ASSAULT - An unlawful attack by one person upon another for the purpose of inflicting severe or aggravated bodily injury. Although actual injury is not a requirement this type of assault usually is accompanied by the use of a weapon or by means likely to produce death or great bodily harm."

"ASSAULT - Whenever one person makes a willful attempt or threat to injure someone else, and also has an apparent, present ability to carry out the threat such as by flourishing or pointing a dangerous weapon or device at the other. An "assault" may be committed without actually striking or injuring another person. (same as forcible assault)

An assault is any unlawful attempt or offer with force or violence to do a corporal hurt to another, whether from malice or wantonness; for example, by striking at him or even holding up the fist at him in a threatening or insulting manner, or with other circumstances as denote at the time. an intention, coupled with a present ability, of actual violence against his person, as by pointing a weapon at him when he is within reach of it. When the injury is actually inflicted, it amounts to a battery.

Assaults are either simple or aggravated.

    1. A simple assault is limited to the use of physical force and result in little or no injury to the victim. Where there is no intention to do any other injury. This is punished at common law by fine and imprisonment.

    2. An aggravated assault is one that has in addition to the bare intention to commit it, another object which is also criminal; for example, if a man should fire a pistol at another and miss him, the former would be guilty of an assault with intent to murder; so an assault with intent to rob a man, or with intent to spoil his clothes, and the like, are aggravated assaults, and they are more severely punished than simple assaults."

"BATTERY - Harmful or offensive contact with the preson or another or with something closely appurtenant thereto, caused by an act intended to result in such contact or the in the apprehension thereof directed at the other or at a third person."

I really dont think that hockey or any other sport for that matter will affect paintball.... stuff like this happens all the time it isnt the sports fault it is the person.... nothing whatsoever to do with one but the cat that slammed the other guy....

Hockey is, inherently, alot more violent than is paintball. Brawls are fairly commonplace.
Whereas in paintball, I think I've only seen a couple of physical confrontations, mostly limited to pushing matches.

In the event that a player makes violent, physical contact with another player I believe the autorities should be involved.
Physical contact is not part of this sport. Let alone physical violence.

Aside from being shot point blank in the mask or punching, kicking someone, you really cant get hurt by another player in paintball. If you get shot 20 times then you will have 20 welts. No big deal. People dont get injured by overshooting so I think this hockey thing doesn't really aply.

)It depends on if the over shooting was intensional...everyone who has played paintball knows there is a reasonable amount of time before you know to stop shooting (mainly cause you know in paintball its like you are shooting a nickle everytime that ball leaves the barrel)...I have seen players though punches in paintball...(theres a movie link somewhere, it mightbe 300fps idk)...just over a game...Its just people with bad attitudes and too much pride (Go AGD PRIDE , thats good pride)...dont blame the game blame the people.

ive watched the video a few times, and every time i watch it, i feel worse and worse for the sport of hockey.

I really hope that this doesn't come into the sport of paintball as prevelant as it is in hockey. I dont see (then again, i dont watch other ML sports other than football) this type of activity in other sports, and I have certainly not seen nor heard of this in paintball.

either way, here are links to the 2 videos that i found:

Shatnerball 2, a player was KO'd when he leaned into a stream of balls being shot by a guy behind him (The closest the the "real story" I've been able to fathom from 5-6 versions of the story). The game was suspended for ten minutes or so while the refs made sure he was ok.

Skyball '04, a ref in the rookie division was KO'd after taking an unknown number of balls to his head. The game was held around him while he lay unconcious on the ground.

Two seperate incidents in 6 months of each other that I witnessed. In both cases it was multiple balls, back of the head, and the victim was knocked out cold. The reactions were different, but the results were the same in all cases. There's also the alleged "LaSoya Incident". I say alleged becasue there's 3-4 versions of the story floating around.

                          Cryer had a good point.....
last year at a regional tourney in colorado, Chris lasoya, shot another player something like 8-10 times in the head and knocked him out to the point that an ambulance had to be called. now, i really thought more should have happened to lasoya, as that was a dangerous situation, whether he meant too or didnt. (he said he didnt mean too, sound familiar?). so this bertuzzi situation could very well carry over and sort of has already, to paintball, the next time someone takes things a bit too far in paintball, and WHEN it comes to a point of injury SERIOUS injury, then consequinces will go up. as paintball grows we will see more in action injurys that are a result of player negligance or plain revenge, (hello, bonus balls?). or how about when Mr U (world cup) went after salm in the woods with no goggles on, and salm kept shooting at him, that was attempted assault as i see it. or it actually did come to police action when a player at the same world cup brained another with his tank, and police were looking for that player, i am sure they didnt want to just "talk". so i belive that we will also bring it on ourselves (the paintball community) and you will see more law enforcment involvment in paintball.

                          Shane-O

BTW, the lasoya incident did happen, jessica sparks spoke to chris about it, his excuse? you know how fast i can shoot those guns (angels), and IIRC it was wayne samuels that got bunkered, i belive guy cooper told me that.
I have nothing good to put here...........

The way I see it, when 2 hockey players throw off there gloves, that is an aggreement to fight. Fighting is acceptable in hockey, but not when the other person isn't willing. That's the way I see it.

OK I stand corrected. Had no Idea a paintball to the back of the head could knock you out.

Spaceman : Yes, Sat evening was the KO incident.

Shane : I'm not doubting that it happened, I wasn't there and I can't really comment about it. But it's been repeated over and over now, several people have taken multiple, repeated blows to the head with paintballs, and have been rendered unconcious.

We all know paintball is a dangerous game. I would like to see the players take that risk more seriously, and minmize that risk to theor other players.
