so i bought a mag off of a guy on ebay....

i sent him the money last wednesday (the 27th) and he hasnt emailed me back since along with the fact that i havent got the gun yet, and he only lives 3 hours away so it shouldnt take more than a day and a half to ship.

if he is scamming me, is there anything i could do to get my money back or what?

Why would you waste money shipping if he only lives 3 hours away I would get some friends and go visit him.

Sent as in snail mailed him the money? The shipper has like 30 days to ship it to you. Perhaps the mans out of town?

If you sent it via Paypal you have little to worry about. Paypal allows you to file claims against individuals who do not ship items. There are time restrictions on the claims however and YOU should research what they are and how it is all done.

Give the guy the benefit of the doubt and then stick it to him through Paypal. Also, if you paid with credit card, many CC companies are now pursuing non-shippers online.

Many eBayers don't ship the second they get the money. Give the guy a week or two before you crawl all over his nuts.

Call him.. most people dont know but ebay has a function that allows you to get the sellers or buyers phone number given to ebay when they signed up(if they give fake phone numbers its reason to be kicked off ebay)

Simply go to help and search for "Sellers contact information" It will appear as a link. Id give you link but it changes every couple of days for some odd reason. Anyway you can request his contact information and get his phone number. It automatically sends him your phone number too by the way.

Regardless you should be able to call him and find out what the problem is.

And to the person that stated paypal has a protection program... that is not true in all cases.. The seller has to have a paypal account in good standing. IE 6 months or more on that acccount with a verified address and bank account to get the $500 paypal protection. Otherwise it falls to ebay.. which has a $200 fraud protection. Ebay makes you pay $25 to use this protection though so the max you can get back after being scammed is $175. And this will take 2-3 months to get back.

Honestly though if someone lived 3 hours away from me and I was itching to get the gun I'd just drive up and get it. Save some money on shipping and no chance of being scammed as I'd bring the money with me and not pay over the internet.

Oh also.. using the above method of geting the phone number also gets the address.. So if you dont already have his address you'll be able to find it out and pay a visit. For future refernce always call the seller of any high ticket item you buy.. a couple minute conversation will tell you if he is scamming or if he actually has the item etc.. Not fool proof but it helps.

Worst case if you payed with a creditcard you can always call your credit card company up and have them reverse the charge on fraud. If this doesnt work(it normally does) you can use Ebays protection service to get back $175.. becides that you're out of luck. Hope this wasnt an expensive gun !

Maybe the man is busy. I know i work all the time and have to squeeze it into my schedule to ship something. Since its really only been a week give it some time. In a month, then i would start to complain.

A month ? unacceptable.. I expect a package to be shipped within the week I have sent payment.. Legally by ebays standards you have 20 days.. But that is very very unacceptable...

Waiting any longer then a month is more then rude is just unprofessional the expectation on ebay is to ship within a day or two the seller gets payment.. anything beyond that he should list in the auction. Waiting longer makes you more prone to fraud. The longer you wait the harder it is to do a chargeback... paypal fraud claim.. etc...]

Use the above information to call him.. If he doesnt answer to the call after several tries report false contact information to Ebay.. Will make it alot easier when it comes time to report a claim.

Are you serious? You would honestly wait 30 days to received something you paid for?

If you have to "squeeze time" into your schedule to ship something that someone paid for - you probably should be selling anything.

If you took the time to list the item for sale (Ebay, AO, PBN, etc...) you owe it to your buyer to take the time to ship what they paid for.

brutus106: If you have his addy, goto www.anywho.com and get his phone number. Also, you can file a compliant through Paypal - the seller has 2 weeks to either refund your money or provide proof of shipment.

I was just trying to make a point. He bought it not even a week ago. It takes a couple of days atleast to ship it and mind you it was over the weekend too. I would expect it later this week if not early next week. If not, then start to ask questions.

I guess I'm the only one who thought of the obvious: what is the shipping method? Just because he lives three hours from you doesn't mean it's going to take a shipper three hours (or even days) to get it to you. Could you post a link to the auction? I think most people who have replied are being unreasonable, considering it's only been a week since you sent payment. I'm just curious as to what was stated in the listing.

That's an expectation YOU and other buyers have set for yourselves, and people who set their own expectations generally set them way too high. The seller has NO obligation WHATSOEVER to send the item so soon after payment unless he stated so in the listing. If a buyer had the nerve to call me a week after I received payment wanting to know where the item is, I'd tell him to go to hell and it will get there when it gets there. If I hadn't already sent it, I'd wait as long as I could just to spite him.
