        Technically, the AGD Paintball gun is the 68Automag. If I remember correctly, Tom said they added the 68 to avoid infringing on the nakesake, and I guess since it's in a different market, it's no issue.

          Yeah, AMT's had gear out for years, they're prety much collector's items at this point since AMT is long gone.

          The name difference is pretty easy, AMT put a space between the two words, Tom didnt.

                        In my non-educated opinion (Im not a lawyer) its a clear violation of trade dress laws. Use of the name, or a name so close that it could confuse consumers.

                          They have AutoMag, AGD has 68Automag. That capital m will probably prevent any legal action.

                            well look at wal-mart and k-mart, they dont sure over the use of mart. And if im not mistaken, there are other products with the name automag in it.

                                Anyone can sue anyone over anything. I don't like your hair color, I can take you to court because if it. I probably would not win and be laughed out of the court room, but I can do it. The name automag can be used, but I am sure Tom does like it being used in the paintball world. I don't think it falls under trade dress, but I am sure you could convince the court that they are in the wrong.

                                This is kind of like Apple computers and Apple (the record company). They had an agreement from back in the early 80's where Apple computer would only use the name "Apple" in the computer industry. When they moved into the music market (iTunes) the name "Apple" was going to used. Apple (the record company) put a stop to it.
