    Nyc Paintball Ban

    Here is the offical press release concerning the ban and the fines for the stores that were carrying paintball markers.

    The premise: Items are outlawed or regulated because their lawful use is dangerous (drugs, alcohol, driving, etc.). If you purchase any item which has a benign purpose (toy guns, pencils, baseball bats, screwdrivers) and use it to conduct an unlawful act (each item previously mentioned has been used in a crime at some point in time), do we ban the sale of the item?

    The big question here is the purpose of the law: To protect the innocent or protect the guilty. We're protecting the guilty (no one accidentally used a toy gun to get themselves injured or killed), not the innocent.

    You'd think they'd outlaw real guns instead of toy guns first. Oh, yeah, they can't, because they are too easy to get in the black market. Oh, yeah, toy guns are easy to buy in New Jersey and Connecticut.

    What's the point?

      The worry here is not the crafting of new laws but the application of old ones (did I see 1955?) by someone who, it appears, is targetting paintball. A mass difference between the laws earlier this year where the crafters did not see paintball as the target.

        Basically and they have been running this old law into the ground around paintball dealers since 1995 now? It is a shame really.

          My concern is by close reading of MI law a paintball marker is a firearm... and then falls subject to dueling laws, etc.

                  I think I might have to raise the BS flag on this one. In TN, it's illegal for frogs to croak after 11 PM. That's just rediculous. No one, in their right mind, could come up with this law. It's beyond funny or have-to-be-there for it to apply- you can't make a law about frogs! It could be something about having frogs as pets, but methinks some important details have been left out of most of these things.
