      I wouldn't be too worried...

That's what insurance is for - people get into accidents. Your insurance company will not pay right away and will defend the suit until they take the guy's deposition and review the medical bills. It should not impact you other than having to pay more for insurance premiums in the future.

In PA, the police will not show up at an wreck unless the cars can not be driven or if there is an injury.

i'm not sure if thats totally true. last winter me and my sister were driving in my dads (new) car and made a left turn when a guy ran a red light and hit us. luckily my sister swerved to the left and he swerved to his left so all that happened was the front right bumper hit his back tire. anyway, his car was barely damaged and the bumper and front right of our car was a little messed up but the cops still came. it may have just been cause the cop was just driving by and stopped to make sure everyone was ok though, so im not sure.

But I will tell you this, you WILL get into an accident!
You're so confident that everyone gets into accidents, but you didn't bother to spend 30 seconds asking someone what you should do?

lol. When the guy admits to doing brake tests in court...

How about he says anything else, and its still your fault.

              "I saw a dog"
"The car in front of me slowed down"
"I realized I was going to fast"
"I was looking for my exit"
"My foot slipped onto the brake"
"I accidently pulled the emergency brake"
"There was something in the road"
"I was pulling over to use my phone"
              "I felt like slowing down"
"I was looking for a gas station"
"I dropped something on my lap"
              "I was changing the radio"

              etc

"didn't bother to spend 30 seconds asking someone what you should do?"???? What is that supposed to mean? Christ almighty, I'm not looking for a fight, just help. If you don't have anything nice to say, don't say it at all! I am a good driver, can't say the same for you, but I can guess that you either don't have your license, or you're just some random inconsiderate jerk! You're not helping. And BTW, only a few of those reasons in your 2nd post would work.... keep in mind this is a major highway. No gas station nearby, domestic/wild animals, etc... and if he was pulling over, he should've signalled first, and checked his blindspot, like I did, then made his way into the right lane, instead of irradically stepping on his brakes. The only thing that would hold water would be the "the guy in front of me stopped" argument, since it's the only thing feasible in this situation...

and joey d- thanks for the help, man.... traffic was I'd say between moderate and light. Most of the traffic got off at exits before (esp. 17). Traffic flow was pretty steady, but we were going pretty slow on that new bridge right before the exit.

Like I said before, I have made a statement on tape to my insurance company about what I saw and what happened. And again there WAS a cop on the scene! He did jack though, but if anything he can be another witness for me since he would've seen if there was a passenger or not in the guy's car. I also gave the insurance company contact numbers for my 3 passengers.

Muzikman- I don't think that's the same in MA. It was rush hour, and our little accident, which we decided to take to the left-hand lane, must've caused traffic problems. A cop hears about this, and is probably sent to check things out... he realizes no one is hurt, so he shoos us over to somewhere out of the way so traffic can keep going, and then leaves.

Oldsoldier- I don't know the details of what he is suing for, but the impression I'm getting from my mom is pretty bad. She says we might lose our house if he wins....? If that's the case, that is a real boatload of BS. I hope she wasn't sugar-coating that ..... hopefully she was just over-exaggerating....

and SMG- I hope that's the worst thing that'll happen.... I was talking it over with my friend, who happened to be in the car, and his dad is an insurance agent. He said that he bets the guy is just looking for a quick settlement from the company, and my insurance will probably go up a bit...

Thats why you dont drive real close to the car infront of you, so if you have to look away, and then see the car infront of you slamed their brakes, you have time to too.

Its a scam, you got done in the butt. He saw you turned away, and slamed on his brakes. You shouldnt of droven so closely next to him.

I wasn't that close, that's the thing, I was a good 2-3 car lengths away.... which is pretty much the most distance you can leave between you and another car in Boston rush hour traffic....well, without having someone cut you off, at least. If you saw the damage to my car you would see what I mean. With any luck the insurance company will smell the BS after looking at the pics of my car (damage not severe at all).

Did you stop before you hit him?

                      You were too close.
