uh oh! Got a speeding ticket in NY need some help.

I got a ticket for speeding. I was doing 50 in a 30. He got me when I was speed up, the 45 sign was right in front of me :-( I was tired and didn't really realize him there or my speed.

Anyway I got a ticket, I have an out of state drivers licesnse. The court date is on the 18th. What should I do? I can't really afford to get hammered by a fine and points etc. In texas and other states you can get it deffered or something like that. Where you promise not to get anothe ticket for 6 months or so. Basicly a probational thing, do that they have it up in NY?

    Thanx guys,
    Doron

What do you mean, in TX they will let you out of a speeding ticket as long as your good for 6 months? Never heard of anything like that in NY. Basically you have no chance of fighting it since you actually did it. What you can do is go to court over it, and hopefully they will offer to reduce the ticket to failure to signal or somthing like that if you plead guilty so they don't need to waste there time with you.

you can try and ask the court to be put on probation for the ticket. Ive had this done a few times, but have had to pay some fines as well on the ticket. what usually happens, is you are put on probation for 6 months. If you stay out of trouble for 6 months, the ticket goes away, along with the charges on it. If you dont, they bring it back for maximum penalty.

      good luck.

          getting it deffered
          i got a ticket for 28 over

I wouldn't just pay it that's for sure. I would at least try and get it mitigated down or try and defer it. I know in Washington if you pay $100 you get the ticket defered and you basically go on probation for 6-12 months where you can't get another moving violation or you gotta pay the whole thing. Either way don't just pay it, you got nothing to lose.

Another thing would be to find a good traffic lawyer in that area that could get it cleared up. If you go to www.vwvortex.com(I know it's a VW site) and go to the regional forums and then go to the east coast you should be albe to search for the names of recommended lawyers in that area that deal with that kind of stuff for decent prices and normally they don't make you pay if they don't get your ticket dropped or mitigated down below a certain amount.

I know I've found 2 or 3 really good ones from that site that I would get a hold of if I ever got another ticket.

Traffic lawyers cost money, and most likely there failed criminal lawyers so I wouldn't expect much from them. Most likely your not getting out of it, I would just try to plea bargen it down, and take whatever you can get.

I talked to a lawer in the family, he said to get a lawer that is in that town to deffend me, much better than having it go on my record.

I don't think they can charge your court fees for that. Making you pay for your own trial?

Well, if the lawyer can get you off then the ticket won't go on your record which means that it doesn't get sent to your insurance company and in turn saves you on insurance which in the long run can be spendy. And I know the few reputable lawyers in western washington that pretty much everyone in the dub community use are damn good and have almost a 99% success rate and if they don't win then you don't pay which is a good thing. I'm sure there's some in that area that you got your ticket in.

I talked to my bro In Texas they must give you 10 days by law before the court date. They gave me less than 8 days in NY. I duno if they have that law up here, though I was curious.

My stepmother had to wait months for her her trial on a driving to slow ticket. I don't know of any law like that around here, you would need to speak to one of them traffic lawyers to find out most likely.

I'd just go to court and plead guilty. Tell them exactly what happened, and hope their sympathetic. You were speeding, so you deserve the ticket. The signs are in those spots for a reason. Being tired is no excuse for speeding. You can hope that the officer that ticketed you doesn't show up. I dont know if it works this way in NY, but in NH, if the cop doesn't show up, then the ticket is dropped. Most of the cops don't show up to the court dates either. I hope you get out of the ticket, but even if you don't, it shouldn't be to much money. Just pray that the cop doesn't show up. Maybe you could call him with a bomb threat on the court date or something to get him out of there.

You can still get a ticket if the cop doesn't show up. But its alot easier to get out of without the cop there.
