    the Waco massacre (homework help)

    Hey all,

I have a presentation on wednesday about the Waco Massacre in my US History class, and I need some help. Out of the six questions that I have to answer I'm having trouble with these two:

~What legal issues or constitutional considerations are relevant?

~What government agencies are or were responsible for providing security in this situation? What were some of their strategies and tactics and were they appropriate?

has anybody else done research on this topic? if so can you help me out a little bit?

    .....ummmm ...HELP! ....

The search warrant they used was outdated, and could ONLY be served by the local Sheriff anyway. The government murders of the Branch Dividians was an illegal operation from the get-go.

The govt. broke numerous federal laws, while never finding ANY illegal activities at the compound.

If my memory is correct, the government agancies involved were the FBI, ATF and the DoD (provided armoured vehicle support).

As I understand it, the main legal and constitutional issues would be (1) the right to bear arms; (2) freedom of religion; and (3) the right to be safe from unreasonable search and seizure.

American news gets reported in Canada. I've been old enough to pay attention since Reagan was President. Plus my Grandpa was a big fan of the USA, and so I learned a lot about it as a kid.

Plus nothing ever happens in Canada, so they only get news from the USA!

Well, not so much gunfire and explosions, anyway.

We've only had three or four armed-standoffs in the past 15 years, and none of them were so spectacular as Waco or Ruby Ridge. Well, maybe Oka.

i also believe there is an alleged violation of The Posse Comitatus Act of 1878. Due to having US Army "advisors" during the siege.

Yes. Ruby Ridge and Waco both were improper use of the Army. At Rudy Ridge, Army snipers were the ones who fired the shots and in Waco, there was military personnel on the grounds. The only military personnel that can be used legally to quell the people is the National Guard, if my informant told me correctly.

I would like to know more about the validation of what I was told though. I think it is right.
