    roommate rant

    WoW .. what a morning..

    I woke up at 8pm to go to my 9pm computer company job .. work 11 hours a night for 4 nights.

    My roommates take me aside and tell me that, even though I'm on the lease, they are "giving me 2 months notice" to leave. Apparently because I don't really talk to them (i have nothing in common with them) they want me to move out so that an "occupants" g/f can move in.

    WTF! ... needless to say I thought everything was fine .. I had no problem with these 2 guy's ...

    Now i'm worried they have some sort of right to kick me out .. and then where the heck do I go?!?! I will be calling a lawyer and a couple paralegals on monday to figure out if they have some sort of right to do this .. cuz my one roommate .. who seems to be the "ringleader" isn't a dumb guy ...

    Man, i'm getting kicked out cuz my roommates need a puppy.

    Read the lease, the whole 2 months notice thing sounds like part of a lease agreement or so they are trying to have you believe.

    I work the same basic shift you do. Interacting with those daytime creatures is hard.

      seriously though .. i've heard of things like this from landlords ... but from another tenant??

      I'm gonna take my lease to a paralegal on monday and have them read it .. and tell me what my rights are ...

      no matter how much it costs .. cuz i simply have no place to go until october when the lease officially ends and I was planning on moving anyhow.

      Although .. I guess I do have a friend of mine who did say something about getting an apt .. now that I remember .. maby I should talk to him too!

        if oyu hold the lease theres nothing they can do. As the lease holder you are a proxy owner and hold the rights rent a room to whomever you like. Also you can have any occupants evicted based on a standart 30 day notice. If they fail to meet your deadline call the cops and they will litterally through their stuff out on the curb.

        ...I've seen some crazy stuff relating to roomates... but this takes the cake. The leaseholder is being evicted by his renters. I would up their rent. They don't like it... they can leave.

            One of the guy's is an "occupant" and is nameless on the lease .. and it's HIS g/f that's plans on moving in .. i am a Tenant (leaseholder) and there is another guy on the lease as a tenant (leaseholder) .. so basically I guess I could kick the one guy out and say "good riddins" ahah .. cuz i know my friend would move into this place in a flash ...

            that would sorta brutalize the other guy huh...

              Heat is correct. Roommates who are NOT on the lease can not evict someone who IS on the lease. In fact, if two people are on the lease and one wants the other evicted, they have to go through the landlord and have the lease changed. This may, or may not break the current lease agreement, and how that is affected is usually up to the landlord.

              Are you the ONLY one on the lease? Or is it you and someone else?

              (you posted the answer to my question while I was posting..... no, they can't do that. And you can do what you just posted.)

                One thing you need to ask yourself: if you win, how badly do you want to live with two people who hate your guts?

                Stuff will disappear. Things will break. Shared bills wont get paid. Mail will disappear. Music will get louder late at night...

                My suggestion: Win in a way that those two move out. Or don't win.

                    I was just about to post something to this effect.
                    Pick your battles, man. If I were you, I would aim for having them evicted and if that doesnt pan out, just move your stuff (and some of theirs) in with someone else.

                      or, violate the lease agreement , and have everyone kicked out...nah you should send your roomates on a little bus trip and while they are gone, have a lawn sale selling all their stuff.

                        thanks guy's .. i needed some of that ... well i told the occupant that i'm staying .. period. He's gonna tell the other lease holder (interestingly, his brother) ... and well ... i suppose time will tell! ..

                        I think i'm gonna put a lock on my door and i will pay my share of the rent directly to the landlord ... and any shared bills .. you want my money, gimme a reciept with a signature ...

                        *sigh* ... why must roommates sux ... i really dun wanna deal with the tension

                          A 10 foot whole and cement. Ask they guy if he can help you out down there. Fill hole with cement. Problem solved.

                            I think spending the rest of your life worried you'll get convicted of murder would be a WEEEEE bit worse than moving to another apartment

                              In all honesty, I agree with the person who said to pick your battles. Nothing is worse than comming home to a tense household. Don't do anything that will overtly piss them off. Just tell them that you plan on moving out when the lease is up, and not before. Also, I'd keep a close eye on my stuff; if I were you. Anything that could be considered yours that is of high value, I'd keep in a secure location. Pay all bills directly. Or, cancel ones that you don't use a lot i.e. cable, phone, etc. Get a cell phone. Put yur T.V. in your room. If this leaves them with out one, then screw 'em.
                              Bottom line is that when you move out, take all of your stuff, and none of theirs. Don't do anything that they can't press charges against you for. Just let them know that when the lease is up you are gone.
