PI is short for personal injury. I absolutely would not settle this case until I had an attorney review the case in detail. Generally, PI cases are settled based upon a multiple of the "specials" which encompass medical bills, out of pocket expenses, and pain and suffering. A multiplier is used since generally there is no way to account for pain and suffering. Nobody can give you an informed reccomendation regarding settlement except an attorney. The case could be worth the policy limit or several hundred thousand dollars. Wihtout having all the facts it is too hard to say.

I took a civil law class last year. The teacher was a lawyer that specialized in wrongful death/ wrongful injury cases as a plantiff's lawyer. You want to get all your damages paid for and then extra for things like discomfort and it being a tramatic experience. Lawyers take about 1/3 of what you would get. Best consult one for all you could get the guy on. You can get more money for things like loss of recreational activities if you can prove that you did something on a regular basis and are/were not able to do it anymore. Talk with your lawyer.Comment

Ask for enough money so it covers your surgeries, legal expenses, damages to your vehicle, and I'd say about 30k to 40k for yourself. But, just like everyone else said, I would consult with a few attorneys before you actually do anything.Comment

I would ask.. knowing the situation, etc. Do you think 50K is fair? Lets not be a get all you can society, is it fair to you? If the answer to the question is an honest no... see a lawyer. I got hit by a mini van (both our faults pretty much). Snowy and couldnt see eachother.. Compount fracture just above my ankle, broke my leg in 2 spots along with the compound. Tore my spleen in half, broke my wrist and cut up my forehead. 1 1/2 months or so in hospital 1 week in ICU and about 3 months doing the whole "physical therapy" thing. Totaled out to around 120-125. Id aim around there seriously. The bills pile up fast when it comes to medical attention..

First, ask more than you expect to get. Second, expect to go to court to attempt to get the money. Settlements, especially large ones, people can drag on into court for years.Comment
