    I don't understand the coralation between buying a faulty item ( a car that throws a rod two days later) and not reading the FULL description of an online auction (such as this thread is about). They are two completely different situations. If I was told that I could get the car at a great price but I may run into a problem with the rods soon that is quite different. That may be somewhat similar but you are comparing apples to peanutbutter

      honostly people, if you are really stupid enough to buy it and expect to get an ipod u just dont deserve to live and make your own decisons(sp?). he clearly states what he is selling, its not a fraud by any means. it wasn't even in small text.
      If you went to Best Buy and bought a 40in plasma tv, got home, opend the box and found rocks and a piece of paper telling you where you can buy a 40in plasma tv for a good price would you be angry? What if in small letters the box said "This box contains rocks and information on where to buy a plama tv. Their is no TV in this box". I bet you would be pissed

        I think most states have laws saying used cars purchased from a private seller (not a dealer) are sold as is. That means the seller can say whatever they please and cannot be held liable for any of it. Usually unless it is an extreme case (like you bought a Ford pickup and found out it was a chevy, milage was intentionally misrepresented (illigle in itself), etc) you arn't going to get anything but screwed out of it. So when you buy a used car from a person it is safe to assume the car is sold "as is" even after any statements made by the seller.

          Agreed about the "as is" laws if as a consumer I am unaware of these laws that means I have to deal with the consequences. Also if you buy a used car from a private party and don't have a machanic or atleast someone who is compitent with cars take a good hard look at it if it is not mechicly sound TS. If the person will not allow you to have a mechanic look at that should be a red flag. This is not about anything other than being an educated consumer. It is a shame that so many people are out to take advantage of people but it is a bigger shame that people allow themselves to be taken advantage of. This is not someone solociting elderly people with the promise of financial security for a nominal payment. It is an unsolicited commercial advertisment on an auction website. I was unaware that it was not a valid form of auction on Ebay but if it is stated and someone doesn't read the entire description that is their fault.

            Edit: I remember an auction a while back for a special edition intimidator (i cant remember which..doesnt matter)...anyways, it had a huge description, etc., then at the end of the description it said something along the lines of "this auction is for a picture of the special edition intimidator.".

            Very Tricky. And the price got up to past $1000 too...

              if i went to best buy to buy a tv i would look up that tv. i look up almost everything i buy, espcially something like a 40in plasma tv. i do research to see how good it is and how the buyers rate it. beleive me if i was buying a tv i would know everything about it. espcially if it is a tv or a list now if the guy said to me this is a list and i bought it and found it was a list instead of a tv, that would be my own fault.

                most of you are wrong, the i pod which gave the description and then tells you that its only giving you info in fine print is a total rip off. its fraud plain as fricken day, don't give me this "oh you don't deserve to live" crap. people make mistakes. I would love to see the face on one of you jerks who said that to buy a paintball gun filled with crap in it. its ethics, which a lot of you don't have.
