    not necessarily 100%. From what i gather, he was stopped and/or easily visible to the lady that hit him. Because of this, she becomes the primary cause of the accident. If you happen to see a car stopped in the middle of the road facing the wrong way, do you keep going & say "Meh, he's on my side of the road it's his fault"? No, you're at fault because you knew he was there and yet you still hit him. But then again, I don't have the complete picture.

    68mag, file a police report if you already haven't, there may be laws making it an offence to not report an accident w/ more the $XXX of damage. Make her file a claim with her insurance, dont file one with yours unless she wont. It may be a hassle to get it all settled, but stick it out. idk what MX-3s are worth, but you may get a check for a few grand in the mail
