    First speeding ticket

    Well there is this divided highway where I live that is pretty much a straightaway, a really long straightaway. I was coming home last night around 4:15am and for some reason I decided to gun it. I was going along in the upper 90's (speed limit is 55). I got off the road no problem and didn't speed once I got off the road. Probably a quarter mile off the divided highway I get pulled over. The cop said he saw me speeding but doesn't know how fast I was going, all he knows is that he was going 90 and having problems keeping up (I didn't see anyone behind me while I was on the divided highway and the cop was in a Ford Exploer). Anyways he wrote me a ticket and said I have to show up in court, he didn't write a speed on my ticket he just wrote violotion of 40-6-181. This is my first offense and the road I was speeding on was completely abandoned.

    Has anyone else been in a similar situation? I really can't afford the 1300 dollar fine that comes with going 35mph+ over. The cop doesn't really know how fast I was going and I think I might could use this to my advantage?

    Only break the laws you can afford to pay for. My wise stepdad once said. Not to be an *** or anything but it does make sense.

      That suxs man. I would try and fight it. It sounds like he wasn't to sure about it so he might not show up to court. Also do some reaserch online, I'm pretty sure that there are ways for you to get out of it if the ticket iwasn't filled out right. Good luck bud!

        speedometers in cruisers are digital for a reason. they can be used in court as a radar device... 35+ or double the limit is considered a criminal charge, in MA, as opposed to civil.

          Good luck getting out of it, police are legally experts at eyeballing speed, so in court their professional opinion is acceptable as evidence. However, you could very well get it lowered to below 90 and reduce the fine. Hopefully though when you go to court the cop wont even show up.

            It was a stupid mistake and I'll admit that. Hopefully the judge will have sympathy on me seeing how it was graduation night and I could have made a lot worse decisions. (I know a lot of people got pulled over that night for DUI's)

                lol some cop pulled me over on my quad for speeding...........in a field i got a warning though

                  Well about my entire graduating class (475 people) were at this one huge party that got busted up by the cops, so about half of my graduating class go stuck with a DUA or a DUI. Compared to all this my offense doesn't seem as bad.

                    but that has no bearing on you speeding. Good rule of thumb for courts. Dont try to get sympathy let them hear your story and let the judge decide.

                      being a high school student, who probably hasn't had his license for a long time -- I'd watch out. They may try to teach you a lesson. Does the ticket have a section that shows if the offense is a "civil" or "criminal" charge? It should.

                      If it's criminal, you're screwed!

                          Same thing happened to my brother, but he was going 115mph on I-95. He went to court, cop showed up and my brother asked to see the radar log, the cop couldnt produce it, so the charge was dropped. If the cop dosent have a log of you speeding, charges will be dropped.

                            Actually, in the state of CA, A highway patrolman who has been on the job for more than 3 years is considered an expert witness when it comes to speed. Their opinion carries the same weight as, say, a medical examiner.

                              I was going down 247 last week cruising about 75 and passed a cop. Never seen him turn around. I got passed all the traffic and bumped it up to about 95-100 (55mph zone). Cop was back behind me the whole time, i cruised right thru a red light and went about another mile or so and then i looked an my mirror and it was nothing but blue lights.

                              I pulled over, end up being a pretty cool cop. He only got to clock me at 75 and never got me at 100. He said he was going "124" and was trying to catch me. He thought i was running from him. but ended up only writing me a ticket for running the red light and expired tag (my brothers car). He wouldnt let me drive home and made my mom come pick me up. Ticket only ended up being $110. He gave me a warning for "unknown racing speeds" and reckless driving.
