    You will have no trouble in court getting it changed to 50:50 fault... Make your case well, and you should be fine...

      I don't know Pyro, my non-lawyer opinion interperts that to mean that you can only be passed on the right where there are two lanes intended for traffic.

        Just talked to someone I know who works for Geiko. They said the other guy is 100% at fault for passing on the right no matter what I did. I don't think I'll have any problem getting this changed to 50/50.

                Why the heck would you want to do that. It's 100% the other guys fault. No excuses, plain as day.

                A simple picture taken of the location will show ther is no way to legally pass on the right.

                And legally speaking, "sufficient roadway" for a motocycle is NOT just any space they can fit in.

                  Exactly, and I still argue that the laws you posted prohibit passing on the right except where there is a lane.

                    Well I called my insurance company today and they told me their is nothing I can do right now unless I want to file against his company for the damage to my vehicle. Basically I just wait, he will contact his insurance company who will look at the police report and decide who they belive is at fault. If they find me at or partially at fault I'll hear from my insurance company when they make the claim at which time I can go fight it.

                    I called the police department to see if I could ammend my statement and they told me those statements are not admissable in court. I have no idea why not and have a feeling they might show up again anyway. But their is nothing I can do about that. So it's all in the hands of the insurance companies now.

                      Update:
                      The guy called me today and told me it was $1643 to repair the bike. I'm currently paying $900 a year in insurance because I have a discount for being away at school. Should the accident be reported to the company even if I end up being not at fault I loose that discount and my rate is going to increase to probably about $1850 where it was before the discount. If I am at partial fault which I'm sure I would be it will increase more than that, $500 or so minimum. So I think I'm pretty much screwed into just paying for the bike.
                      Tommorrow I'm going to call my insurance agent and ask if my rates will increase even if he doesn't make a claim. If she says they won't then it looks like I'm paying.
