    kicking out a house mate.

    Does anyone know the legalities of kicking a roomate out?

    I lived here way before he did, my old roomate graduated. I live in a private two bedroom apartment, not on campus.

    And he has turned out to be completely delinquent and and is completely unlivable. All he does is drink, use my stuff and eat my food. And be completely rude and hostile, as if he was trying to kick ME out. I have tried to straighten it out for months and by now I'm either going to kill him, beat the **** out of him, or not live with him. I'll move if I have to but I was here first.

    He signed the lease agreement, but like I said I was here before he. Eh?

    Also I own practically everything in this place, the chair, the $1000 Tv, the game consoles, the microwave/toaster/water cooler, the two aquariums, and my name is on all the bills.

    Speak with the landlord. Most likely, only he, not you has the power to evict him.

      give him the boot ..

      if his name isnt on any of the bills .. he would be asked to leave by the police ..

      i would think that would be the end of it ..

                Tell him you are requesting to be off the lease.[leaving] Pack it up and move on.

                  ah my brother had a problem like this. he's sharing a pretty big apartment between 4 or 5 guys including himself. theyre all juniors in college, at UVM. well anyways one of the kids decided to take my bro's car out while he was drunk and scratched it up, needed to replace side door. after alot of arguing, talking to lawyers, the kid payed for it. he thought he didnt have to pay! now its all fixed, the kid pretty much moved out cause noone at the apartment liked him anymore.

                    I had the same problem...

                    One of you will have to get released from the lease. "I was here first" doesn't count; you are both equally responsible for the rent in the eyes of the legal system.

                    Talk to the landlord. Whatever you do, do not make threats or harm him in any way. Does he use drugs? Let the cops know. Has he threatened you? Let the cops know. You have to start a paper trail to cover your backside and be able to document that his continued living in this rental property is a danger to you, and more importantly, to the property owner. Again, the landlord is your best approach.

                    That jerk I lived with only wanted to be released from the lease when it got ugly between us. I took a bath because I was responsible for the full rent for the rest of the lease term (about 5 months), but it was worth it to have that idiot gone. Good luck!

                        If his name is on the lease you're screwed. If not then go through the eviction process and you'll be fine and won't get sued for wrongful eviction.
