    Fighting my ticket on Tuesday (Help!)

    This will be my first time ever and some advice would be really helpful right now--what to wear, tips, etc...

    This is my case:

    The cop said I was going 55 in a 25 zone. My case is that where the cop was parked, there was no way that he could tell I was going 55 in the first place--therfor he's lied about me going 55.

    Now, in this picture, this is where the cop was parked. The green little sign you see way down the road is the city limit--meaning 25 miles/hour limit has started. I was coming towards the cop, and said i was going 55 before the green sign. But obviosly, he can't even see beyond the green sign, so how could he tell I was going 55?

    Now, in this picture you see the green sign, and THEN the sign saying 30 (which was actually 25 when he pulled me over) and the 30mph sign you can't even see in the picture above!


    Any suggestions on my case? I'm extremly nervous about it...

      You're better off to bargain with the DA... if the cop actually shows up for a hearing/trial... then you're *deleted*. Probate judges RARELY listen to some teen over the word of a formal officer. Go talk to the DA and tell him you have sport commitments, school, and/or a job... he'll either significantly reduce your suspension, give you a special permit, or he will rip up the ticket... the pics are only going to prove that you're a whiner... and they dont like whiners!

        could always try asking for proof of:

        last calibration date of the radar gun along with a read out showing whats its +/- values are to shows its accuracy

        when the last training/retraining of the officer was on the proper operation of the radar gun is/was

        if they cant provide try to get off with that by saying how do we know that the cop was trianed on the guns use and that it had not been tampered with

        this also helps is the cop that wrote the ticket is not there esp on the last one

          Oh yeah, this all happened 9/7/01, when the leaves were on the trees blocking the view all the more.

            Whether or not he could visibly see you speeding is irrelvant, his radar gun has a longer range than his eyes. If the gun picked you up, fighting over his vision is irrelevant. Then gun picked you up, not his eyes.

            If you talk to the DA, you can usually get away with paying more money, but they drop the points. They just want thier money, they dont care about your points.

                you wont win. at best youll get reduced points.

                if you are missing work for this then you are losing more money than you need to.

                but my guess is the "theres no way he knew i was breaking the law" defence wont work.

                    There is a very good chance that the cop willnot show. Unfortunately if he clocked something on radar what is to say you were not going faster after the sign. I would bring the picture and your explanation. Dress in suit and tie. And do not argue with the cop or the judge. Be polit and tell your side. If he shows up you will lose. But if people don;t stand up for what they believe in the system will never change.

                      god, all these people don't know the easiest way to get out of a ticket. 2 words: supportive deposition(sp?). this is a report that the cop must fill out and give to you explaining everything that happened. if you don't have this paper by your court date, then it gets tossed. unless the cop really has it out for you, then they usually don't show, or write it. now, the only thing i don't know is if you're supposed to ask for it on the first court date or the second. i'd look into it if i were you. all my friends do it and they usually get out of it.

                              Ok I'm only telling you this because your an AO user. If you mail in the ticket, pay 7 dollars over, this will create a overpayment. When they mail you a refund throw away/ burn the refund check. The court will get the money, and no points will be assesed to you since the transaction was never really finalized. This is a proven method taught to me by a Police Officer several years ago, it has worked for me on 3 seperate occaisions. Good Luck !!!!!!!!!!
