Well a few weeks ago, I sold a cocker to a kid in Clearwater FL, im currently in Deland near daytona. It was mailed on the 28th, the money that was sent to me for the marker went to my paypal account, and was put towards bills after the cocker had been sent, that was on the 28th of october. So three days go by, package hasnt arrived, another week, then two weeks, and the only answer I kept getting from the tracking number and from calling USPS was "Its in transit". Well about a week ago, I recieved a package and a letter from USPS stating that the contents of the package I had sent were lost. Upon receipt of this package, i IMMEDIATELY messaged the buyer stating what had gone on and that id replace the $200 seeing as I didnt insure the package, because it was being mailed...3hours away. She of course doesnt find this to be a good enough answer for her, and keeps threatining legal actions, so my question is, is there anything that she could possibly take legal action on?

Wait, you are willing to refund the money because the package was damaged/lost, and the buyer isn't happy? Frankly, he/she doesn't have a leg to stand on. What the hell could they do with legal action, make you pay back the money? You already said you'd do that. Make you send the product? It's been lost, you have proof.
Send 'em their money back, and be done with them. Just make sure you document the hell out of your refund, such as using a USPS money order and making sure you photocopy it before sending. -
I have pictures in detail of the busted up package sent back to me, the labels, the package, the box inside, PDF version scanned copy of the USPS form that they sent, the works. She is just upset because I cant have the money to her yesterday, im like lady, calm down...I work two jobs, pay to support myself, in the process of moving, being sued, and etc, last thing I need is more BS, just be calm and ill get the money asap.Comment

I said that to her actually. Im just trying to make sure my arse is covered, this last month has been pretty bad and im struggling to get back up and going, and only being 19, I cant just pull $200 out of my arse. I have my old job trying to appeal for back payments from when I drew unemployment, basically im being sued for back pay... so the last thing I need is this crazy broad, just need to make sure I gots everything covered is all.Comment

Pay something with a note indicating when the rest will be refunded. Send it by certified mail (they have to sign for it). It makes them taking legal action much harder (well, much easier for you if they actually do) if you can document you are taking steps to rectify it. Not to mention that since they paid with paypal and did NOT select paypal insurance and did not request it from you, they have VERY little to stand on. I agree with Tuna (insure everything - well worth the few dollars) and especially Lohman -- get a MO for like $20 which is 10% and send it certified mail.
Of course that is if you wish to do the generous thing. The perfectly legal thing to do is tell her this is exactly why you shouldn't buy online without insurance. :/Comment

Wow, buyer unhappy with refund? You could offer another marker in similar cost range as substitute. If it's not being hand delivered it gets insured! The only execption to this is something like ebay sales or something where the buyer doesn't want to pay an extra $1 or $2 for insured shipping. Sometimes I get it insured anyway and always use tracking. If they say no, then it is on them. Thankfully, I have never had a problem!Comment

Yea went with the delivery confirmation, insurance didnt even cross my mind on a package only going three hours away. I agree, and I very much understand that I could just tell her that she needs to take it up with the post office because what happens with them is out of my control, but I was trying to be nice because lets face it, ive gotten ripped pretty badly, and it just sucks, I dont want anyone to go through that. Maybe, gets kinda sticky about that when you are dealing with a minor. I personally insure everything I ship.
