I had the pleasure of meeting and playing with Mr. Kaye at last years Shatnerball. I am hoping to get a response directly from him, but any other feedback is welcome. My friend is on probation and according to his probation he cannot possess, own, or use a firearm, and according to his probation, a paintball marker is considered a firearm. Therefore he cannot play. The fallacies of a "marker" being a firearm are obvious to the paintball player, but not to the general public. I live in Wisconsin. If there is any information that you have access to that would help, that would be great. Also, do you know of any cheap plane tickets to this years Shatnerball?

its technically a firearm state by state i suppose my dad whom is an officer of the law himself says anything that launches a projectile is a firearm despite my arguements that paintball markers arent or sling shots)

I don't have any info that would help him. My sugestion is to talk to his probation officer and try and make a deal by doing something extra. If he does so many hours of community service will they let him go to Shatnerball or something like that.

I think a case can be made that Firearms definition is a Federal issue and not a state thing. ATF controls them and they DO NOT control paintball markers nor does ATF classify them as a "Firearm" I think. So I would make the argument that it is NOT a firearm. However any municipality may restrict them specificaly. But I do not think that a local authority can rule them "A Firearm" as that is Federal Jurisdiction. And Tuna pointed out the particular legal precident to you. Thats your best argument. But if I was you I would research the ATF definition to be sure. I think it is not according to them.

paintball guns are not firearms! airguns are not firearms! if they were you would have to follow all the laws that apply to firearms such as filling out a form 4473 when buying one. also full-auto pb guns would be illegal unless they were manufactured before 1986 (grandfathered guns made before that date would cost you a $200 tax, a visit to the local dps, fingerprints and backgroung check). The media/antis have distorted was a gun is so bad that nobody really knows anymore (ever notice that every shooting the news reports is comitted with a semi-automatic assault machine handgun using cop killer bullets?). batf has defined exactily what is and isn't a firearm. see:

check your local laws at:

You are correct. Hence the reason why you can UPS them all over the place. Try that with a fire arm. They need to go to a local licensed dealer if crossing state borders.Originally posted by cphilip
