      If WDP would be exempt because they are not an American company, what about AGDE? Couldn't they make X-Mags safely?

        I think that all of the e-gun makers should put aside thheir diferences band together and just crush Sp.

        Also if AGD goes to court I'm gonna send them 20 bucks to help them cover legal expences. It's not much to the individual's expense but if many people do it it'll help AGD out alot.

          You assume they care. Look, it's not a secret that the All A's have been long conxidered the "cheating team" of all cheating teams in paintball. It's about winning at all costs. (Post edited to avoid a libel lawsuit, hey they're suing everyone so why take the risk?)

          I'd be surprised if they even gave an airborne reproductive act with a rolling fried pastery about what the industry thinks. IMHO, they never have. It's about winning.

            I AM however curious how AGDE sees this dilema they ARE outsidee the us... with AGD and AGDE become ONE company now? I never even though that far out to consider this.

            SP is now the King of paintball. Like most kings they got there by lieing, cheating and killing. But like all kings and kingdoms... they will eventually fall. It's just a matter of time. But until them.... LONG LIVE CCI!!!!

              well, I suppose that's kind of my point... they don't care. SP has no regard for anyone's welfare but their own. Neither did firestone before the excrement hit the fan with their tires. I'm just saying that this action reflects their morals... and they stink. Cheating, stealing... if those are ethical business decisions, then I will most likely have a very very short career in business.

              However, just because they don't care doesn't make me feel like just accepting it... doesn't matter to me if they listen or not... somebody will, and will make a different purchase because of it. If I only cost them a few hundred bucks in the long run, then that's a few hundred that won't fuel their theft...

                    I saw that on forceofnature.com as well. It is a real bummer when this sort of thing happens. I mean, i heard that they were going after ICD because they were a weaker company than some of the big one, like WDP.
                    I know that DYE has already signed a deal with them, and I'm not sure who else has. Does anyone know whoelse has signed with them? And, wouldn't this create a monoply(sp?)? Just when you thought things were looking up for paintball, here come Smart Parts.
                    My question is how is this going to affect public relations? I've heard that Dick Clark signed with NXL to broadcast X Ball on T.V. and how might that affect this?

                      Liable is the written form of the tort of fraudulent misrepresentation. It's verbal counterpart is slander, which you're probably familiar with.

                      To be guilty of either, you have to lie about someone or some company to the extent that it damages their reputation or business.

                      But the key is, it has to be a lie.

                      Written lies = liable, spoken lies = slander

                        Ok thanks. I kind of wanted to know because I run the http://www.geocities.com/smartpartssucks website and I wanted to make sure I wasn't setting myself up for trouble. But everything I've put on the site is true so I guess I have no worries.

                          Errr, Tyger, if you are worried about libel, don't send out any emails on the subject. Even a "private" conversation may be considered "publication" for purposes of libel or slander.

                          Just to clear a few things up:

                          "Libel" is a form of defamation, akin to "slander."

                          "Liable" is what happens when you are found responsible in a civil lawsuit, like being found guilty in a criminal context.

                          "Partial summary judgment," as referred to in the press release, means that ICD lost part or parts of their lawsuit, as a matter of law, but not all of it.

                          A settlement, 9 times out of 10, means that one or both parties wanted to end the matter, usually to save expenses. What REALLY means ICD got screwed is the Consent Decree. Whereas settlements almost always include clauses which specifically deny any liability, consent decrees usually mean somebody was hurtin'.

                          And yes, before anybody asks, I admit it: My "name" is Marchborne, and I am a real, live, lawyer.
                          (although I own an armchair).

                            Just think of this. The Gardners were instrumental to getting Dick Clark to step up to the plate and air the NXL. And the Gardners are, all together now, Smart Parts owners.

                            And March : good point, but in that case I can say that it's not on mass publication, just telling a frindd what was reported to me.

                            DK : My problem is that the 'information' I have is not provable. I've heard the same story from 3 sources on 3 occasions, and I know full well that if I post it I'll need to prove it 150%. And I can't. Anf "FOAF" info isn't the best.

                            Now I could say it allegedly involves the All A's allegedly giving money to a tournament producer to allegedly throw a tournament, then using that tournament win to allegedly sell paintball equipment by advertizing that you too could win with that gear, just like they had, and it made them a lot of money in the process. Can I prove it? No. But like I said before, I've heard it from enough reputable people to think it did happen. But, I can't prove it.

                            Anyhow, yeah. I distrust SP, but the products I have I'm not going to toss into the bonfire. Money spent is money spent, no use throwing it away. But I won't be buying anything from them in the near future.
