      hmm...i would organize a bunch of covert ops, all with mags and swim around the boat of the owner, capture him and use meaningless threats to force him to STFU about patents. but thats just me

          Just wait until they get to NPS, BE, and Kingman. They are going to save those last because they are much bigger than they are. Some one will beat SP eventually. And think what would happen if on SP made electros. Then everyone would grab a x valved mag and AGD would grow. That would be pretty cool. Instead of everyone chanting mags are for ***s, the would chant imps are for ***s. Well no one here chants that we are ***s.

            Actually, NPS already signed a deal with SP. BE will probably be last, as they've just been bought by a multi-billion dollar a year company (and SP will have to go after BE, because of the Rainmaker and the sear trippers like the E-Prodigy).

              Yes you're right. I forgot that they has already signed an angrement(sp?). I guess when it happened everyone was talking about the settlement with ICD and such. I think BE can beat them. After all they were just bought out by K2 and now they are even bigger.

                first,

                Smart Parts has yet to sue: WGP, Tippmann, WDP, Kingman and Brass Eagle. They have signed with NPS and Dye. They have settled with ICD. They are in battle with AKA.

                Smart Parts will have to sue each and every one of the first list, as NONE of them intend to give up their electros.

                This will be nearly 4-5 years before all that happens, and when and if they ever get to BE, BE will do just what they know best: be a bully.

                  the only thing that sucks with sleeping though Sp tearing up smaller companys first (other than watching decent companys get beatten on like patsy's) is that the suits that SP wins against the smaller companys sets a legal precident that can be used against the larger companys. Thus makeing the once shakey and utterly moronic suit of smart parts a more potent one to counter.

                    I dont agree with what SP is doing, but to look at it from a buiness point of view. what they are doing is very smart. companies do this all the time, take over other companies or trying to push them out to gain market share.

                    now if they come after AO, well gathering outside of a court house to "show support" wouldnt do a thing. free and open competitive markets benefit comsumers. nothing says AGD or WDP or WGP or any other company couldnt do they same thing that SP is trying to accomplish now.

                        Actually, there is an SP lawsuit pending against WDP in the US. I have seen the court papers. I haven't looked at 'em lately, but WDP lawyered up prety well with a solid IP lawfirm.

                        As to why SP hasn't sued the REALLY big boys yet, i.e., BE and Kingman, that's pretty obvious. The more "wins" they have under their belt, the better. Essentially, they are establishing a string of precedent they can take with them when they eventually go after BE et al. They got some precedent from a few preliminary decisions in the ICD case that will help them down the line. Another thing to note: settlements (as in NPS and DYE) don't count as legal precedent.
                        Sleep? Isn't that a completely inadequate substitute for caffeine?

                          what would happen if agd loses and all the other smaller companies and then one of the bigger companies beats sp? would all the smaller companies that settle get back any money they paid or what not or will the other companies just be screwed outa a lot of green backs?

                                There was no final order on the merits, since ICD settled, but there were some preliminary decisions made by the judge which, IMHO, were part of what induced ICD to settle (i.e., the rulings were not looking good).

                                While a final ruling on the full merits would be better from SP's perspective, another court could still accept the preliminary rulings as persuasive (as opposed to binding) precedent.
