Personally, I'd focus on the "willful and wanton disregard for the safety of persons or property". Make sure you read alll applicable laws and rulings before battling this out in court though. Get as much info on the judge as possible too.
Willful and wanon are both judgement calls as is the relative safety of people and property. Do you know how fast you were going and the distance between you and people/property?Comment
