She wasnt convicted of the original charge, she was convicted of lying to the investigators. That is a way for the government to save face after their original case went to crap. Do you know how often Government investigator's get lied to? Sure would be nice to get 5 months for all of those cases too, but it will never happen. I think our tax dollars could have been put to better use.Comment

I believe the amount she made by selling was 80,000. And its estimated if she would have not sold that particular day that she would have lost 30,000 hence the amount of her fine. The profit she gained is what they fined her.
She will not appologize I do not think. She feels she did nothing wrong. She got a call from her broker telling her to sell. And thats what you pay brokers to do. However you do not expect your broker to use insider information to find out such things. Although you do expect them to work on tips and hunches. If she was never told the real reason was based on knowledge her broker gained from the president of the company then she herself was not guilty of anything. However she should have just said that. Instead she lied about it. And then recanted that lie. But it was too late. So they prosecuted her for the lying.
By the way Her stock is up. And her Kmart deal is renewed. She will come out of this intact. Not going to long term affect her very much at all.
Why wouldn't she get the minimum sentance? She has never been in trouble before. Most people would get the minimum as a first offender. If anything at all. Many people would not even do jail time. Fines and probation would be more likely in a case like this for someone who has never broken the law before. However I think the jail term is a mandatory so there is no alternative for the judge to grant.Comment

What annoys me about Martha Stewart (and all the other crooked CEOs, CFOs, Board Members, etc) is that they're making people look bad. To the "Middle Class" (I'm not sure what that means now days, everybody has a different definition) it looks like all corporate people are corrupt etc etc. Of course the liberal media doesn't help. It's like the way people seem to think that everybody making over 100,000 dollars a year didn't work their arses off to get it. (totally different subject, I won't go there right now)
So that's my biggest beef. I don't really care what happens to her, I do like her show sometimes cause they make good stuff, but I find her to be a cold hearted old hag. Whether she goes to jail or not doesn't affect me so whatever. I think it's funny though that if she hadn't lied, she'd not be paying huge lawyer and court fees etc etc and wouldn't be going to jail. Of course I wouldn't mind getting locked in her house for however long....
