    Send them the reports you do have from teh police, pictures of the damage, and estimates from three body shops. Send it by certified mail (they have to sign for) with a letter stating that you expect to hear from there claims department with a satisfactory resolution within 72 business hours - have that letter notarized. I expect you get a response pretty quickly, if you don't consult a lawyer.

      my insurance company have every bit of info that is needed on MY end
      the law in my state is that they need to find out if the driver of the vehicle is insured or not
      sending letters and phoning the driver and getting no reply practically gives them a loop hole to slither out of...kinda "well we TRIED to contact them for you...errr.but they dont want to talk to us...so sorry...pay us anyway"

          The law in your state (I don't know) is likely that they have to attempt to contact and there is likely a spelled out response time. I recommend seeing a lawyer. However, sending things by certified mail, notorized, often gets results because it will be forwarded from some "drone" up the chain of command because it looks official.

            So they wont cover you on the unisnured motorist because the guy will not answer his phone? Sorry, but that just doesnt fly. I'd look at the exact wording on your policy, and maybe speak to a lawyer.

            I'd also try to talk to the chief in the neighboring town. The whole way they dealt with a hit-and-run is inappropriate, even if it happened in another jurisdiction. So, if I shoot someone and run to a neighboring jurisdiction, I'm all set? Lame.
