    In MA at least, the accident is always the fault of the person in the back. I you rear-end someone, even if they cut you off and come to a stop, it's your fault. Stupid laws...
    I don't know about MA, but in TX you can get the ticket if you got hit and had stopped in the middle of the road. It's failure to yield right of way or stopping in the flow of traffic or something.

    If I was in this situation, I would stayed in my lane and hit her. I am not going to watch out for some moron that puts me in danger.
    I would made sure she had damage to her car, got the ticket, paid for my repairs, and after it was all over I would have followed her home and kicked her dog for good measure.

      I say you did the right thing. What if there was a baby in the front seat that you couldn't see? How would you feel then if you knew you could have just hit the curb? Yeah, it sucks that she didn't get in trouble. She probably doesn't even know it happened, but nobody got hurt so that's good.

              I'm guessing this is why you've run into two cars in the last year ? .....maybe why you have a big dent in your front fender, bumper and no headlight on your passanger side too? Yeah its wrong to avoid hitting someone

                  Same thing in Illinois, if you rear end someone, it is always your fault basically unless you can somehow fight it with proof. You also get a ticket for following to close.

                    babies arent supposed to be in the front seat for that exact reason. maybe thats just in california though.

                    personaly, i would have hit her. if she is in 2 lanes and blocking half of your lane and stops, then she is retarded. if she signaled and checked her blind spots and then changed lanes but stoped half way, then she didn't scan the road ahead to make sure she could complete the merge; which is stupid. whereas, if she didn't signal, and merged into your lane without giving you enough space infront of you, and you hit her, then i think she is at fault for the accident.

                      i have my permit and i turned 16 on monday and today an integra pulled out in front of me like 10 feet while i was going about 30 and about 10 min earlier my mom was talking about getting me a giant car so i wouldnt die in a crash -we were driving a miata. and i said i can avoid an accident in a small car. so this integra pulls out, and i do this swerve into the other lane and peeled out a bit and the integra slams its brakes and then speeds off, it was kinda fun

                        Me too, and I learned it the hard way. I won't avoid hitting someone unless I know I can do it without hitting something else.

                        It sucks. I guess you can just think of it as a really expensive lesson.

                          Samething always happens to me. When a car slammed into me from the side and flipped my jeep I could remember thinking about trying to get out of the way. I moved left, but didn't want to jerk the wheel and make things worse. I stomped the gas to the floor. I watched it hit. I countered steered to attempt to keep the vehicle going straight. I remember thinking as we were going over, come on, it wasn't that big an impact. I know I didn't over react. All that in less that half a second.
