traffic ticket question.

    traffic ticket question.

    Well, late last night i was going out to my friends house out of town.. and i met him at a video store in town to get a movie to watch.. on the way home we were on the 4 lane and i passed him going around 50.. he passed me going probably 60 after that(speed limit is only 35) and after that i let off and slowed down to 40 then i looked back and saw a car coming up on me reallllyyy fast.. so by that time i figured it was a cop, and a few seconds later he pulled me over(my friend was in front of me this time) so i pulled off and stoped. my friend kept going, so after about 10 minutes in the cop car our other friend who was with the friend i was racing was stupid enough to call me.. the cop answered my phone (without my permission) the cop didnt know what vehicle my friend was driving nor his lisence plate number..and the cop told him to come back to where he had me pulled over.. so he did, and the cop gave him the same ticket/violations that i got.. but my real question would be can he give him a ticked with just answering my phone and telling him to come over there and get a ticket??


    ps. the cop never clocked us(my fuzzbuster woulda jammed his radar anyways) so he just took a wild guess at 70 mph..and we were never going near that..so i guess he cant get us for speeding.

      That will never stand up in court.
      You and your friend should both plead not guilty and take your chances in front of a judge.
      If you don't want to do that and you have a good record, then see if you can have it placed on file without a finding for 6 months. After the 6 months, as long as you don't get caught again, the ticket will be thrown out and never show up on your record.

        1. You shouldn't have been speeding in the first place.

        2. Fuzzbuster lol. They have this thing called lazer.

        3. Any kind of radar jamming device is illegel (at least here in ohio). Would probably land you a heftier fine than the speeding ticket.

        4. Be happy he didn't write you up for recless operation/racing.

          I dislike patrol police with a passion. My beleif on speeding is that if I can control my vehicle at a high rate of speed I should get a pat on the back instead of a ticket. The only problem is that I am not the only person on the road so I have to obey local laws.

          Your friend came back Id be gone. When we/my friends go riding (sport bikes) if the 5-0 shows up everyone playes scatter.

          As far as fighting it in court GOOD LUCK. I have found that it is not easy at all. Your best bet is to try to go to traffic school. Tell the truth if asked what happened, and hope the Judge beleives you. (dress professional in court it gives you a "hey this is a good kid" look)

          You may or may not to listen to my advice I have lost my licence for +100 in a 40, and about a dozen other charges.

            The cop cannot answer your phone without express consent. The US Supreme Court ruled (forgot case, will look it up if need be) the electronic devices are to be viewed as containers of information and cannot be opened without warrant (much like a locked suitcase). He violated your 4th amendment right protecting you from search and seizure unless you are not telling the whole story and he had probable cause that and his action prevented eminent danger to the general public.

            "Fuzzbusters" can detect X/K/Ka/Kb radiation ("RADAR" that police use), lazers, and some can detect IR. All of these freqs can be scrambled or disrupted. Jammers are illegal in most (if not all states). Detectors are legal in many states. If you had a jammer you would be in a bit of trouble most likely. If you have a $30 K-mart detector he could have clocked you with any of the above methods.

              Also, he coulda paced you. that is a valid method of clocking in most states.

                    Smile, take the ticket, and be glad he did not write you up for racing.

                    As to answering your phone... no clue, not a lawyer, and this is different then searching your phone for info, its answering a ringing phone.

                    The point is, you probably committed more than just a simple traffic offense by racing - if you get out of it as a traffic offense be happy about it.

                    Most cops in MI are not certified to take radar - so now, since they are "professionals" there estimation holds up in court, they don't even need a radar reading.

                    Reckless / careless driving is not necessarily speed related....

                          According to my digital forensics class (My minor is DF) it is not. Any time he opens or activates it in a way not authorized by the oner, unless in eminent danger, or preventing it, he has violated the 4th amendment rights of the owner of said phone. It is a warrantless search if the officer had to do anything to the phone (so much as pushing a button). This is according to what I was taught in class.

                            only this could happen in the states. for one thing the cop wouldnt take ur phone, or even be allowed to touch it. nextm you wouldnt be taken into custody if in his car or anything
                            all you would have gotten here is the ticket nothing else. i dont know how it will work there but here i would fight the cop in court on the account of the cop being a dink

                              well ill pay the ticket.. this definatly isnt my first.. and im not one bit mad about it..i was being an idiot. and got a ticket.. o well it happens.. but my friends mom doesnt think the cop did his job right and wants to fight it.. as for me, i sent my check out today for them. and im sure this isny my last ticket, im not done being dumb at 16.
