Yeah, it bears repeating: Make him pay for it no matter what. Small claims court may be a good idea, but just think of how long the case would take to reach a judge. THEN, figure in the court costs and lawyer fees.

      ....

Actually, that may not be a bad idea. Just as long as they give you the money he owes you AND reimburses you for the legal costs.

By the way, I know this has been going for a while, so how's the situation coming along? Has the little guy fessed up/payed you back yet?

I think that in addition to paying you back/buying you another 'Trix, he should let you shoot him point blank in the arse three times. THAT'LL learn him.

Ya whats the update, and I'm pretty generous and usually will let people borrow some of my stuff most of the time but a new trix! I would be way to overprotective of that, is this kid a very good friend of yours?

IIRC most small claims courts are for monetary claims under $1000.. I could be wrong though. If he is the one who stole it we are talking about a felony3 or 4 theft.

I think your being played. One has to have some serious shortcommings to lose a thousand dollar marker that isn't even theirs.

Either way I suggest that you use this opportunity to practice being a complete ***hole. Get as many people involved in this as you can. Tell him to go to the cops and file a report. If he doesn't send the cops to his house. If he stole it, or knows who did he'll be nervous and probably start changing his story around. If he didn't steal it, oh well, he diserves to be harrassed anyway.

Whatever you do, don't do as some have suggested and just write it off as "a bad deal" because it is easier than confronting people.
