When I went to court my license was suspended for the offense of posession of marijuana less than one ounce. I was not told how long the suspension would be for, so I had to have my lawyer check into it. About a week later she gets back to me and tells me it is for six months...that time period was over yesterday.
I called the DDS today to make sure all my ducks were in a row so that I could come down and take of this. I have completed my classes, paid my fine, and served the suspension period. All I am supposed to have to do is bring them $210 and pay the fee, get my license back.
Well they tell me that they have not gotten the disposition from the court, and that I would have to call over there and have them fax the info over and paperwork would clear up in a few days.
I call the courthouse and after a few moments on the phone with them I get put on hold for about 10 minutes. The clerk tells me that according to the court paperwork that my suspension was for 12 months and that they would not send over the paperwork until the end of that time.
I of course questioned that as I was informed by my lawyer of a different situation. The clerk said I was convicted under first offender and that was the disposition. The judge refused that plea and made me plea guilty under what they call "first in five". I have read the code, checked the DDS site, and found a court policy handbook and everything says the suspension period is 180 days. What really sucks is that the DDS has a policy that states they can make you submit payment for the re-issuance and THEN start the suspension period, at their discretion.....
Well anyway, after going back and forth for a moment, even going over the paperwork that I have that does not state a suspension period like it is supposed to according to code, the clerk tells me that I need to contact my lawyer.
I pick up the phone and call the firm she worked for and she is no longer in the directory, and no one will pick up the phone at the offices.
At this point, I don't know what I am supposed to do. I apparently have six more months of suspension to serve that I did not know about, could have more after that according to if the DDS feels like it, and cannot be issued a temporary work permit.
