      On a brighter note: If everybody, including several eyewitnesses, agreed that it wasn't your daughter's fault... then justice will be served!! Have faith in the court system, and be glad your daughter is physically okay.

            Most likely we should assume it might be the Girls parents or insurance company hoping to get out of it some what. Have no idea why but I would think Money would be at the root of it. Seems to always be. Fear or threat of increased premiums or something. Sigh.....

                Why on earth did I think anyone would do the right thing? It seems NO ONE does the right thing now days. And I am tired of being screwed because of it. Enough is enough.
                I'm sorry to hear that they're dragging this out further. My guess be that the girl talked to a lawyer and heard her options, which most likely is why she's "changed" her mind. All this is doing though is dragging you and your money further along, in hopes that she gets a little "sympathy" from the court and judge so that she can keep her license or something of sort. As long as you have the eyewitness and testimony from others, she'll have just wasted time and money. It's a shame though that it has to be dragged out. I wish you and your family the best.

                  Wow, I thought this would have been taken care of way before now. When I read the thread title agian, I was a little worryed. As for the whole insurance thing, even if she pleads not guily she is going to be found guilty.

                  I think this girl is either really ignorant, or did not pay attenion in drivers ed. If I remeber correctly, which I do. The pedestrion (sp) ALWAYS has the RIGHT OF WAY. That means if your daughter was crossing the street the car should have yeilded for her. Not ran over her. I figure she just wansn't paying attenion, you know how teenagers are I mean you have raised how many? I really think that they are fighting a loseing battle and just putting stress on your family that doesn't need to be there. I mean you have ban-dus to make I wish you the best of luck and hope for a short ending to this mess.

                    that's horrible. ugh i hate people. always thinking of themselves. someone probably told her to do this though. most likely her parents. isn't that a lovely lesson to teach your daughter? it doesn't matter whether it was really your fault or not. fight it and minimize the cost to you.

                      I am glad to hear your daughter is just fine. That being said, make sure she limps into court! Seriously though, It is time to bring in a lawyer and file on that stupid young lady, her parents, and insurance company! They need to be taught a lesson. I am thinking a six figure lesson!

                            one question begs to be asked though...

                            where was the crossing guard at the school?

                            I don't know how things work in your neck of the woods, but around here, where there is a place where a student may need to cross an intersection, busy or otherwise, there are crossing guards.. was there one in your daughters case? If so, you may want to also grab their side of the story too. If not see next statement..

                            while you are at it, attend the next PTO/town/school council meeting and query WHY was there not a safety officer assiting students/kids that needed to cross the street.

                            also, if things (for any reason or another) do not work out in court.. you should be able to press charges against the school system for failing to keep your child safe while in under the school systems responsibility

                            not many people are aware, but school systems are responsile for your childs health and well being until they REACH YOUR DOORSTEP. so, if your child is injured at school, especially in this case where it seems there is no crossing guard/safety officer present, that the school is negligent.. and sam, you should seriously pursue that, if for nothing else than getting a crossing guard/safety officer put in place at the school to prevent such an incident.

                            anyways, good luck with this, im definately pulling for you, and if you need any help, legalwise that is, you let me know and I will do what I can. (my mother happens to hold a doctorate degree in criminal justice )
