        A lot of interesting posts on this topic.

        Certain items are classified as firearms. Certain items are classified as weapons. Anything can be used as a weapon. There is interpretation involved when presenting a case for infraction of rules involving a weapons or firearms offence.

        I believe an airsoft gun in its base form does not fall under the category of a firearm. If it is not used for malicious intent it probably doesn't fall under the category of a weapon either. The airsoft guns are clearly marked to distiquish themselves from real guns. This is to prevent them from being used for malicious intent. Just because an item looks like a gun, does not make it a gun. A water pistol can look like a gun. A water pistol can also be made to fire a projectile (water stream) at a high velocity. Obviously a stream of water is nonlethal, but if contacted in the eye at close range could cause damage. So, do water pistols now fall under the same classification? I can fabricate an elastic band and paper clip combination that can severly injure a person at a considerable distance. It doesn't have a classification. If I put it on a stick with a handle such that it looks like a gun, does it magically change the classification to a gun. I doubt it. My point is, that the airsoft tool is not a gun but a piece of sports equipment used to fire a nonleathal projectile at another person. Heck, a baseball being hit by a bat has more impact power as does a puck being hit by a hockey stick.

        Since the airsoft gun in question was never loaded or used at the residence and does not fall under the category of a firearm, then there is grounds for appeal to the sentence. Even if you don't care about the punishment, this could stay on a permanent record that could affect future employment.
        Except for the Automag in front, its usually the man behind the equipment that counts.

          Althought I disagree strongly with the rule the rule is in place in his college that classifies that airsoft marker as prohibited, regardless of other legal classifications. Those same rules allow for quasi-legal proceedings in which you have limited rights to defend yourself against school officials who are immune from normal judicial safeguards. The rules suck, but he signed a contract to abide by them. Again I disagree with doing it, as to get an education in many places you must live in there residence halls, and agree to these. I have an issue with signing the contract under duress as I feel there is an implied threat to "not having a higher education" but my viewpoint on that is, admittedly, extreme.

          Bottom line, regardless of what constitutes a firearm and what does not in the real world his school, under the contract he signed defines it as anything that shoots a projectile (second hand info here) and has the authority to hand down ludicrous punishments as it sees fit for violation of there weapon's policy. I do not agree with the policy or the methods of enforcement, but there is really not much he can do about it.

              we use them because they work, and they do it faster than anything else. americans seem to have this need for speed and effectiveness and eficiency, the firearm embodies all of these traits.

                    NY is only one step down on the liberal guncontrol scale from CA. In CA you can only have a gun like that if you owned one before the ban. In NY you can still buy one made BEFORE the ban, regardless of who owned it.

                          Piston-driven AR = pointless. There is nothing wrong with the system now. Besides, everyone knows it's all about the HK-91.

                            The fact that they are basically forcing you to watch Bowling for Columbine has got to be against some constitutional right of yours. If a left wing nut job told me to watch that movie I would probably read the synopsys on the back and that's all, or just completely make something up seeing as they are most likely not going to read the paper anyways.
